Nevada rancher awarded $4.2M for ‘taken’ water rights
Reno, NEVADA – The U.S. Court of Federal Claims court has ruled in favor of a late Nevada rancher whose water rights were violated by the U.S. Government, the AP reports.
The U.S. Court ruled that when the U.S. Forest Service put up unnecessary restrictions on the methods the rancher could us to maintain his irrigation systems, they violated his Fifth Amendment clause of just compensation for the “taking” of private land. In this case, the Court ruled that the rancher’s water rights had been taken without compensation.
